REGULATIONS FOR SERVICES

on domain registration in .KG zone

 

 

TERMS USED:

 

DOMAIN is a space area of Internet hierarchical names, which is provided with services by a set of domain name servers (DNS), and is centrally administered. A domain is identified by a domain name. .KG is a two-digit code of the Kyrgyz Republic according to the international standard ISO-3166.

 

KG domain-is a top-level domain with a domain name “KG according to the international standard ISO-3166”.  Second-level domains in the KG domain shall be registered in compliance with these Regulations.

 

.KG Domain Zone Administrator-is an authorized body, carrying out management of the .KG domain in the interests of the local and international Internet-community, organizing functioning of the .KG domain Register.

 

Domain registration-is an entry of information on a domain and Domain Name Administrator into a Register in order to secure the uniqueness of the domain use. The service on the domain registration shall be deemed to be provided from the moment when the entry is made on the information to the Register. The domain registration shall be effective within 365 calendar days from the dame of the domain registration.

 

Domain delegation-is provision with a right to use a domain in the .KG zone for an accounting period with entry of information on a domain to the .KG Register and domain name servers (DNS), corresponding to it, indicated by a Domain Name Administrator, securing functioning of a domain within the Internet international system.

 

Register- is a centralized aggregate of databases of .KG domain, containing information on registered domain names.

 

Domain Name Administrator is a person; on whose name a domain name is registered. A Domain Name Administrator shall bear responsibility for selection of a domain name, probable violation of third parties’ rights, connected with a selection and use of a domain name and shall also bear a risk of losses, connected with such violations.

 

Accounting period is a period equal to 365 calendar days, within which storage of information on a domain shall be secured in the Register.

 

Domain re-registration is clarification of information on a domain after completion of an accounting period. A domain reregistration ensures extension of a domain delegation for a regular accounting period.

 

Domain re-delegation is organizational and technical activities on transfer of rights to a domain administration to another Domain Name Administrator.

 

 

Domain technical support is technical activities on provision of a domain functioning (domain name servers’ health, timely provision of information, required for normal functioning of a domain).

 

1.      GENERAL PROVISIONS ON .KG ZONE ADMINISTRATION

 

1.1. The administration of the .KG domain zone is carried out by “ASIAINFO” LLC. A right to administration of the .KG domain zone was delegated by the Internet Corporation for Assigned Names and Numbers (ICANN).

 

1.2. Domain/domains registration is carried out via a Registration Form in Internet at the address: www.cctld.kg or by conclusion of an agreement at the office of .KG Domain Zone Administrator.

 

1.3. The support of all information on names, registered in the .KG zone, shall be made in the Register with an access to Internet at the address: www.whois.kg and www.cctld.kg

 

1.4. At domain registration a Domain Name Administrator shall confirm that he will not violate and will not otherwise restrict rights of third parties. The responsibility for probable violation of third parties’ rights to a trade mark, a name, a copyright and any other rights shall be borne by a Domain Name Administrator, as well as responsibility for conflict situations, arising at the use of names of other organizations.

 

1.5 All contact names, indicated in the Register, shall be accessible via e-mail, indicated by them in a Registration Form. In the event that contact persons are not accessible by e-mail, the .KG Domain Zone Administrator shall not bear responsibility for non-obtaining of information messages by them.

 

1.6. If at domain/domains registration a Domain Name Administrator provided not full or untrue information and if a payment is not made within the period, established by these Regulations, the registration shall be deemed not valid.

 

1.7.  A domain and a right to a Domain Name Administration shall not be objects for purchase-sale operations.

 

2.      PROCEDURE OF DOMAIN REGISTRATION IN .KG ZONE

 

2.1. For a domain registration it is necessary to introduce information via a Registration Form in Internet on a Domain Name Administrator at the address: http://www.cctld.kg or to conclude an agreement in the office of .KG Domain Zone Administrator.

 

2.2. The Domain Name Administrator shall make payment in compliance with Section 6 of these Regulations and effective tariffs. Payment for the domain registration secures storage of information on the registered domain in the Register within the paid accounting period.

 

2.3. At primary domain/domains registration their uniqueness shall be checked, after that a domain name shall be registered in the Register.

 

2.4. Payment for the domain/domains reregistration ensures storage of information on the registered domain/domains within the following paid accounting period.

 

2.5. The domain/domains registration shall not be carried out in the following cases:

 

-             domain/domains names have been already registered;

 

-             domain/domains names do not correspond to Cl. 3.4 of these Regulations.

 

3.      CONDITIONS FOR DOMAIN REGISTRATION AND DELEGATION

 

3.1. For a domain registration it is necessary to conclude an agreement, to send it and to make payment for an order for registration. Upon obtaining of the order and upon receipt of monetary funds at the account, the .KG Domain Zone Administrator:

 

- Registers a domain name in the Register

- Indicates a person, on whose behalf the agreement was concluded with the .KG Domain Zone

Administrator, and the order was sent, as a Domain Name Administrator

- The agreement may be concluded both by a natural person and a legal entity (organization)

- Sends a notification on the domain registration to the administrative e-mail, indicated in the agreement.

 

3.2.       The domain registration and delegation may be carried out only at availability of, at least, two domain name servers (primary and secondary DNS), supporting the domain to be delegated. And at least, two of them must be located in different IP-networks (in different Class C networks according to the traditional terminology) and must have a reliable connection to Internet. The “reliable connection” means such connection, at which total time of connection unavailability with a server does not exceed two hours per day.

 

3.3.       Information, related to domain name servers, shall correspond to the current state of the network.

 

3.4. A domain name must consist of more than one symbol, it must start and end with a letter of the Latin alphabet or a digit. Letters, digits or a hyphen may be intermediary symbols.

A domain name may not start or end with a hyphen, may not consist of one hyphen and may not contain two and more hyphens in succession.

 

3.5. The .KG Domain Zone Administrator shall be entitled to suspend immediately a domain delegation:

- based on the official letter from the Domain Name Administrator;

- based on the legislation of the Kyrgyz Republic;

 

- based on the application from the Technical Support Service of the domain, if after change of information on domain name servers, supporting the domain (Name Server 1 and Name Server 2 fields) conditions, indicated in Cl. 3.2 of these Regulations are not fulfilled.

 

3.6.       In the event that Cl. 3.2 and 3.3 of these Regulations are not fulfilled, the .KG Domain Zone Administrator shall have the right to suspend a domain delegation until violations are eliminated, and payment for the suspended period shall not be returned and a date of the accounting period commencement shall not be changed.

 

3.7.       In the event that information on a legal entity or a natural person, contained in the Register, ceases to correspond to the actual reality (changed), it shall be updated by the Domain Name Administrator not later than one month from the moment of its changing.

 

3.8. At inconsistency of information on a legal entity or a natural person in the Register of .KG zone with the actual state, namely:

- invalid legal address of the organization

- invalid mail address of the natural person or the organization

 

- invalid name of the organization

- invalid surname, name, patronymic

the responsibility for non-receipt of the information on the domain/domains (such as completion of the accounting period, changes in the delegation terms and conditions, etc.) shall be borne by the Domain Name Administrator.

 

3.9.       At violation by the Domain Name Administrator of rights to a trade mark, copyrights, legislation of the Kyrgyz Republic, the .KG Domain Zone Administrator shall have the right to suspend the domain delegation until clarification of the information or to release it in compliance with a court order or based on other circumstances. At violation by the Domain Name Administrator of the third parties’ rights or legislation of the Kyrgyz Republic, payment for the domain registration or reregistration shall not be returned.

 

3.10.     In case of necessity for a documentary confirmation of information, contained in the Register, a legal entity or a natural person, upon the request of the .KG Domain Zone Administrator, shall be obliged to provide a documentary confirmation within one month from the moment of the first request sending. Requests shall be sent by the .KG Domain Zone Administrator by e-mail at the contact address of the Domain Name Administrator, contained in the Register.

 

 3.11.   In case Cl. 1.5, 3.7. 3.8, 3.9 of the Regulations are not fulfilled, the .KG Domain Zone Administrator shall have the right to stop delegation of the domain/domains, in which there is a reference to a legal entity or a natural person, whose data are not true or require confirmation. The domain/domains delegation shall be restored by the .KG Domain Zone Administrator within three working days from the moment of submission of the requested data or confirmation of the available information authenticity.

In the event that a legal entity or a natural person does not submit the requested information or does not confirm the authenticity of the information available in the Register in compliance with the request from the .KG Domain Zone Administrator, domain/domains names shall be deemed to be free. And payment for the domain/domains names registration or reregistration shall not be returned. 

 

4.  DOMAIN REREGISTRATION PROCEDURE

 

4.1. A domain reregistration shall be possible after 100% payment for services. The .KG Domain Zone Administrator shall send a notification to the electronic address, indicated by a Domain Name Administrator, on the domain/domains/ reregistration prior the completion of the accounting period.

 

4.2. In case of non-receipt of a notification on reregistration 30 days before the completion of the accounting period, it is necessary for a Domain Name Administrator  to apply to the Billing Department by e-mail:  admin@domain.kg or by phone: +(996) 312 964488.

 

4.3. The Domain Name Administrator shall be obliged to pay for services on the domain reregistration according to the Section 6 of these Regulations.

 

4.4.       Re-registration shall secure storage of information on the registered domain in the Register within the regular paid accounting period.

 

4.5.       The domain delegation shall be suspended by the .KG Domain Zone Administrator if the domain registration is not extended by the Domain Name Administrator before the completion of its validity period. In case of extension of registration prior, the moment of its cancellation, the domain delegation shall be restored.

 

4.6.       The .KG Domain Zone Administrator shall cancel a domain registration, if its validity period is not extended by the Domain Name Administrator within 30 (thirty) calendar days from the date of the domain registration completion period.

 

5. DOMAIN REDELEGATION PROCEDURE

 

5.1. A domain may be redelegated to another legal entity or natural person based on an official letter from the Domain Name Administrator, provided these Regulations are observed.

 

The letter may be sent by e-mail at the address: admin@domain.kg or by fax: +996 (312) 963434.

 

5.2. When redelegating a domain name, the previously paid billing period is retained.

 

6. Personal data protection of the domain name administrator.

6.1 Service – “Personal data protection of the domain name administrator” allows to hide from public viewing in the registry, the personal data of the domain name administrator specified during domain registration: PID, full name or company name, email address, phone number, address.

6.2 Registration period of the service is one year for the domain name registered in the registry.

 6.3 The service can be disabled by the Domain Name Administrator on his own in his personal account, or upon a written request addressed to the Administrator of the .KG domain zone. In case of early termination of the service “Personal data protection of the domain name administrator” by the domain name administrator, the payment is not refundable.

 6.4 The “Personal Data Protection” service is automatically disabled at the end of the domain name registration period, as well as after the expiration of the registration period in the absence of service renewal.

6.5 When the service “Personal data protection of the domain name administrator” is activated, the information about the owner of the domain name is displayed in the registry – “Private information”.

6.6 The administrator of the .KG domain zone ensures the forwarding of letters to the email address specified during the registration of the domain name.

6.7 The administrator of the .KG domain zone is not a party to negotiations between the domain name administrator and third parties.

6.8 The use of the “Personal Data Protection” service does not release the Domain Name Administrator from the obligation to enter reliable data in the registration form. In case of revealing inaccurate data entered in the registration form of the registry, clause 3.11 of this regulation comes into force.

6.9 The personal data processing is carried out in accordance with the Company Personal Data Processing Policy: https://www.cctld.kg/rus/policy_ru.htm.

7.      SERVICES’ COST AND PAYMENT PROCEDURE

 

7.1. The cost of services on domains registration or reregistration shall be defined according to tariffs, established in compliance with the Kyrgyz Republic legislation (Attachment 2), taxes excluded. *

 

7.2. The registration of domains in GOV.KG, MIL.KG zones shall be carried out only for Kyrgyzstan state institutions.

 

7.3. For legal entities and natural persons: any method of payment (by transfer or in cash).

 

7.4. Charges on funds transfer shall be borne by the Domain Name Administrator. 

 

7.5. Notifications on payments for services on registration (re-registration) and support of domains in the .KG zone shall be sent at the e-mail address, indicated in the contact information of the Domain Name Administrator. 

 

7.6. At preparation of the payment document by the Domain Name Administrator it is necessary to indicate:

In the column “Payment Purpose” – Personal Identity Digit (PID), to which crediting of funds is made or a domain name, for which payment is made.

 

 

 7.7.  For non-fulfillment of conditions of these Regulations and probable occurrence of undesirable consequences for the Domain Name Administrator (domain name(s) deletion) responsibility for the consequences shall be borne by the Domain Name Administrator.

 

 

*  In case of exemption of the Domain Name Administrator from payment of any tax, he shall be obliged to submit confirming documents. Such information is valid for persons, staying on the Kyrgyzstan territory.
